So with no box there his injury doesn't happen? That would be very difficult to prove.

And I can also argue that the Box is inside the wall /railings, not exposed over the surface as they make it sound it is.
This is what I was thinking as well. The box isn't just jutting out into the field of play.

Without getting too deep into the weeds on Illinois tort law, the short answer is that Fowler's lawyer doesn't have to convince a jury (not a judge) that the box was the sole cause of his injuries to recover. He only needs to prove by a preponderance of the evidence (more probably true than not true) that the box was "a" (not "the") proximate cause of his injuries (i.e. a substantial factor contributing to his injuries). It doesn't have to be the sole or only cause for Fowler to prevail.

I'm surprised that Illinois tort law is even relevant to this discussion: I would have expected that MLB players sign away their right to sue MLB or its clubs for stuff like this when they sign their contract, or that this kind of suit is banned by the collective bargaining agreement.

Dustin Fowler is back in the majors and is playing for Oakland this weekend at Yankee Stadium.
