Default Fowler case can proceed...

Don't know if anyone saw this but Friday a federal judge ruled that Dustin Fowler's case against the Sox and the state agency that runs Guaranteed Rate Field can proceed in circuit court.

Fowler's lawsuit filed last December claims the Sox and the ISFA were negligent in not securing the unpadded electrical box he collided with along the right field line.

Judge Gary Feinerman rejected the Sox motion to remove the case directly to federal court.

Fowler is seeking an unspecified amount of money from the Sox and the ISFA.

With him physically capable and currently collecting a ML paycheck I don't see this having any legs in court.

Career ending, maybe different story. And even then, it's a tough case.

He got injured going wreckless into a boundry out of play.

Negligence comes in percentages. If it can be argued that a reasonable person might have foreseen a player going that hard into the stands after a baseball than the Sox or the folks who run GRF might be ruled to share some responsibility and thus owe him money.

If the argument can be made that the injury cost him years of service and/or higher contracts because teams wouldn't sign him to contracts he was on pace to be signed for then the amount of money could climb.

Seems like a potentially legit complaint to me- how would we feel if this was Jimenez- and a few hundred dollars worth of padding was the reason he was lost for a full season?

Fowler was also a Top 100 prospect at one time I think.

Kind of a stretch to say the box was out of play. It was right in the middle of the gap between the padded wall and the padded railing above the wall. That is negligent if you ask me

Was it not part of the wall?
